Employment Practices Liability Insurance (EPLI)
Daycare employment practices liability is a specialized type of insurance designed to protect your company from revengeful or overly-litigious employees.
Don’t want your own employees to take you to court?
A Daycare EPLI insurance policy protects you from many claims that your comprehensive general liability insurance will not, including:
Wrongful Termination Claims
Let’s face the facts: the discharge of an employee has the potential to result in litigation. Daycare epli insurance covers alleged wrongful termination claims by former employees. You can also add a “constructive discharge” provision, which covers against employees who claim that they could no longer tolerate the work environment and were compelled to resign or retire.
EPLI insurance covers claims by current, former, or prospective employees who allege that they were victims of employment-related discrimination on the basis of any federal, state, or local law – which includes race, sexual orientation, color, marital status, creed, sex, national origin, religion, gender, age, military service, disability, pregnancy, and handicap. You can also add a provision about employees who allege that they were discriminated against for exercising their rights under worker’s compensation, COBRA, or other related laws. This policy is subject to future changes in laws that include additional categories of discrimination.
Sexual Harassment Claims
This insurance policy covers sexual harassment claims against your company, supervisors, or fellow employees. Our coverage will protect you from all sexual harassment categories as defined by the Equal Employment Opportunity Commission.
Whistleblower claims are when employees believe they were subject to an adverse employment decision based solely on the fact that they disclosed an unfair or illegal practice. Such claims are also covered in our daycare epli insurance.
Wage & Hour Claims
Frequently – as with other Fair Labor Standards Act (FLSA) actions – wage and hour disputes are not covered without a specific employment practices liability policy. This policy protects against wage and hour claims from both current and former employees.
Other Employment-Related Claims
Our Daycare EPLI insurance policy can also protect you from any other employment-related claims, including libel, slander, defamation, invasion of privacy, mental anguish, infliction of emotional distress, loss of consortium, assault, battery, breach of contract, negligent hiring, supervision, and promotion or retention.
